California’s Proposition 65 (Prop 65) 

COMPLIANCE STATEMENT

California’s Proposition 65 (Prop 65), officially known as the Safe Drinking Water & Toxic Enforcement Act of 1986 (https://oehha.ca.gov/proposition-65) contains a list of chemicals and exposure thresholds which the State of California has determined present a risk of cancer, birth defects or other reproductive harm.

 

Regulus is a supplier of custom products, including parts, populated printed circuit boards (PCBA), wire harnesses, box build assemblies and finished electronic products and they are usually not intended as consumer products. Each part, assembly and product are made to order and to the design and material specifications provided by the customer. Since the products are ordered and/or manufactured on a customer-specific basis, individual analysis of the goods for Proposition 65 substance content is not possible.

 

The assemblies, finished products and their certain components and coatings may contain small amounts of listed chemicals known to the State of California, which may cause cancer, birth defects, or other reproductive harm and they are in a smaller amount than Prop 65’s concern, however the concentration amount of the chemicals are below safe levels determined by OEHHA. We have chosen to issue this warning on all of the products supplied to our customers as an act of caution and because our customers have the right to know:

The products supplied by Regulus Electronics Ltd can expose you to certain chemicals, which are used in manufacturing of parts, components, assemblies and finished products and which are known to the State of California to cause cancer and birth defects or other reproductive harm. Prop 65 Warning Label

Regulus believes that its products are generally safe because these are electronic products that cannot be consumed by eating, drinking or breathing. Nevertheless, we expect customers always wear appropriate personal protective equipment, including gloves, when handling the parts it manufactures and will be fully enclosed prior to end use. Once enclosed, there should be no exposure pathway for Proposition 65 substances used in products under normal or reasonably foreseeable use.

 

California’s Proposition 65 (Prop 65) regulations also requires the manufacturers to attach the WARNING label. Regulus is a "build to print" assembler, an electronics contract manufacturing service provider, each part is manufactured to order and in accordance with the design and material specifications provided by the customers. The potentially required WARNING labels must be of also customer design and included in their specifications as Regulus is not allowed per contract to add labels at our discretion.

 

Since Regulus supplies the customer-specific products and not aware if the goods will be delivered to the State of California, it is an ultimate obligation of the customers to instruct Regulus about attachment of the WARNING labels on the supplied products, including the content of the labels, their size, quantity and their locations on the products. Regulus will not take any responsibility if the customer fails to instruct us about the warning labels prior to delivery of the products to the State of California.
